현재 파리 10대학(낭테르) 명예교수이자 미국 캘리포니아대(어바인) 특훈교수로 있는 에티엔 발리바르는 지난 1980년대 한국 사회성격논쟁 당시 이른바 ‘PD’파의 이론적인 기반을 제공해준 마르크스주의 철학자로 국내에 잘 알려져 있다. 이러한 모습을 기억하는 독자들에게 이 책을 비롯한 최근 발리바르의 저작들은 매우 낯설게 느껴질지 모른다. 그는 더 이상 프롤레타리아 독재를 거론하지 않고 잉여가치론이나 사회계급에 대해서도 거의 이야기하지 않으며, 그 대신 민주주의, 시민권, 인권의 정치, 국민국가, 反폭력, 국경 등을 주요 연구 주제로 삼고 있기 때문이다.
그래서 간혹 발리바르가 사회민주주의자가 됐다, 자유주의자가 됐다는 식의 평가가 국내외에서 제기되기도 한다. 그가 정말로 ‘변절’을 한 것인지 여부를 여기서 따질 생각은 없다. 그것은 독자들이 이 책을 비롯해 앞으로 번역ㆍ소개될 발리바르의 저작들을 읽으면서 직접 판단하면 될 일이다. 다만 한 가지 지적해두고 싶은 것은, 그가 이 책 및 다른 저작들에서 지식인들과 활동가들 및 대중들을 위해 아주 시의적절한 질문들을 제기하고 더 나아가 매우 설득력 있는 답변들을 제안하고 있다는 점이다. 중요한 것은 이 점이 아닐까.
좌파 정치의 가능성에 대한 진단
지난 1990년대 이래 발리바르는 세계화와 유럽 건설이라는 이중적인 정세에서 좌파 정치의 가능성을 모색하는 작업에 몰두해왔다. 신자유주의적 세계화가 전개되면서 민주주의가 후퇴하고 공공 영역이 잠식당하고 있다는 것은 이제 거의 상식이 됐다. 이러한 경향에 맞서 반세계화 투쟁이 전개되고 마르크스주의 이론가들은 다양한 분석과 진단을 내놓고 있지만, 좀처럼 좌파 정치의 재개를 위한 실마리를 찾기는 쉽지 않다. 왜 그럴까. 이러한 물음에 대해 발리바르가 이 책에서 제시하는 답변은 크게 두 가지로 나뉜다.
첫 번째 답변은 좌파 정치를 비롯한 근대 정치가 근본적인 한계에 도달했다는 점이다. 발리바르는 이것을 근대 정치의 모순, 곧 한편으로 보편적 인권 및 시민권의 확립과 다른 한편으로 국적에 의한 시민권의 한정 사이에 존재하는 모순을 통해 해명한다.
1789년 프랑스 혁명의 「인간과 시민의 권리 선언」 이래로 민주주의 국가의 헌정은 보편적 인권 및 시민권을 기초로 제정되고 운영되고 있다. 하지만 다른 한편으로 舊 사회주의 국가들을 비롯한 근대 국가는 국민 국가로, 또는 발리바르의 개념에 따르면 ‘국민사회국가’로 존재해 왔다. 국민사회국가는 사회권을 시민권 속에 포함시킴으로써 각각의 개인이 물질적으로 자립하고 안정된 삶을 꾸릴 수 있는 조건을 제도적으로 마련해주었다는 점에서 보편적 시민권을 구체적으로 구현하는 경향이 있지만, 다른 한편으로는 이러한 권리를 국민에게만 한정하고 있다. 이러한 모순을 그는 ‘시민권=국적’의 등식으로 정의한다.
이러한 관점은 세계화가 전개되면서 나타나는 여러 가지 현상을 설명해준다는 장점을 지닌다. 우선 이것은 사회권이 축소되고 사회적 시민권이 약화되면서 노동자 계급 중 다수가 ‘재프롤레타리아화’되고 빈곤이 확대되는 경향을 이해할 수 있게 해준다. 또한 이것은 세계화와 동시에 유럽 각국에서 극우 민족주의가 맹위를 떨치고 이주자가 배제 및 증오의 대상이 되는 이유도 설명해준다. 사회권 축소의 직접적인 피해 당사자인 하층 계급들이 자신들의 피해의 원인을 이주자에게서 발견하고, 극우 정당들은 이러한 증오에 편승해 세력을 확장해가는 것이다.
더 나아가 발리바르의 설명은 근대 시민권 헌정의 기본 한계를 밝혀준다는 점에서도 중요하다. 그에 따르면 근대 시민권 헌정의 한계는 보편적 인권과 시민권을 구현한다는 그 자신의 주장과 달리 근본적인 배제(시민권=국적)를 기반으로 구성됐다는 점에 있다. 따라서 현재 진행 중인 유럽 연합이 민주주의의 역사에서 새로운 단계를 이룩하기 위해서는 배제의 체계로서의 근대 시민권 헌정에서 어떻게 벗어나느냐가 관건이 된다. 이것은 비단 유럽 연합에만 국한된 것이 아니라 민주주의를 표방하는 각각의 국가 또는 각각의 정치체의 탈-근대적 과제가 된다.
근대 시민권 헌정의 기본 한계 밝혀내
